Guiding principles:
1. A collecting society within the meaning of Section 1 (1) and (4) sentence 1 UrhWahrnG is obliged, pursuant to Section 13 (1) sentence 1 UrhWahrnG, to set remuneration tariffs on the basis of the rights and claims entrusted to it (Section 2 sentence 2 No. 3 half-paragraph 2 UrhWahrnG) in an appropriate amount.
2. Section 19 (2) sentence 2 UrhWahrnG authorizes the supervisory authority to check whether the tariffs published by the collecting society have been drawn up in accordance with the applicable legal provisions. This includes checking the appropriateness of the tariffs.
