"For these reasons the Court of Justice (Fifth Chamber) has ruled in favor of justice:
Art. 49 TFEU is to be interpreted as precluding a regulation of a Member State which has the effect that a company registered in another Member State whose revenue in the electronic communications sector, as defined for the purposes of this regulation, is more than 40% of the total revenue generated in this sector is prevented from generating revenue in the integrated communication system that is more than 10% of the revenue generated in this system.
