PatG § 115 Abs. 2
If the chairman of the Senate orders in patent nullity proceedings that the appellant is given the opportunity to respond to the grounds of appeal within a certain period, a follow-up appeal submitted within this period is permissible in accordance with Section 115 (2) sentence 2 of the Patent Act.
